A three-member panel of the appeal court had earlier affirmed the suspension of Mr Oshiomhole on Tuesday in Abuja.
In a judgment delivered by Justice Mohammed Lamido, the panel dismissed Mr Oshiomhole’s appeal for lacking in merit.
The panel accordingly affirmed the decision of an Abuja high court which had in early March ordered the suspension of Mr Oshiomhole as APC national chairman.
Mr Oshiomhole was earlier suspended by the APC in Edo State in what is part of his battle with the state governor, Godwin Obaseki.
A Federal High Court also ruled that his suspension was legal and ordered Mr Oshiomhole to stop parading himself as APC national chairman.
The suspension was initially lifted after the appellate court granted a stay of execution of the high court’s order.
The appeal court on Tuesday, however, ruled that Mr Oshiomhole’s suspension was valid.
This throws a new twist into the Edo APC crisis as the party prepares for the governorship election.
Earlier on Tuesday, Mr Obaseki announced his resignation from the APC.
Ajimobi
In an earlier development, the ruling All Progressives Congress appointed an acting national chairman after the Court of Appeal in Abuja upheld the suspension of Adams Oshiomhole.
The party said the former governor of Oyo State, Abiola Ajimobi, will be its interim leader.
“Guided by advice from the Party’s legal department in line with the provisions of Section 14.2. (iii) of the Party’s constitution, the Deputy National Chairman (South), Sen. Abiola Ajimobi will serve as the Party’s Acting National Chairman,” the party spokesperson, Lanre Issa-Onilu, said in a statement Tuesday night.
“According to Section 14.2. (iii),of the APC constitution, the Deputy National Chairman, North/South “Shall act as the National Chairman in the absence of the National Chairman from his zone”.”

However, the crisis rocking the All progressives Congress (APC) appear to be deepening by the minutes as Victor Giadom has declared himself the acting national chairman of the party.
Addressing newsmen at the national secretariat of the party in Abuja, he declared that the appointment of the Senator Abiola Ajimobi as acting national chairman of the party cannot stand on the basis that it is illegal and unconstitutional.
The Rivers State-born APC chieftain referred to a subsisting court order issued on the 16 of March 2020 by Justice S.U Bature in suit no FCT /HC/M/6447/2020 as the basis for his ascension to the office of the Acting Chairman of the APC.
He argued “That order could not be immediately effected at that time because of the temporary reprieve Adams Oshiomhole got from the court of appeal on the same day.
“However, having removed the temporary reprieve yesterday (Tuesday) by the court of appeal and considering the fact that we cannot allow for a vacuum, I most humbly inform you that I have assumed office as Acting national chairman of our great party in compliance with the order of the court.”
Giadom, flanked by the deputy national organising secretary, Muhammed Sani Ibrahim, further declared the disqualification of Governor Godwin Obaseki from contesting in the Edo state governorship primaries as null and void.
He thereby directed governorship aspirants of the party in Edo state to report to the national secretariat of the party in Abuja between today and tomorrow to come for a fresh screening exercise in line with the party constitution.
Giadom, who claimed the decision was in tandem with the wishes of the members of the APC national working committee (NWC), declared that Emmanuel Ibediro ceases to be the national organising secretary of the party in line with an Abuja court order FHC/ABJ/CS/733//2018.
