Suspended Chief Justice of Nigeria, Justice Walter Onnoghen, has tendered his resignation as CJN.

Though no official statement has been issued on the development, one of his counsels, who said he was not authorised by Onnoghen to talk to the press on the issue, confirmed this to our correspondent.

Onnoghen threw in the towel 48 hours after the National Judicial Council recommended his compulsory retirement in a report sent to President Muhammadu Buhari on the investigation of the petitions against Onnoghen.

Section 306 says “ (1) Save as otherwise provided in this section, any person who is appointed, elected or otherwise selected to any office established by this Constitution may resign from that office by writing under his hand addressed to the authority or person by whom he was appointed, elected or selected. (2) The resignation of any person from any office established by this Constitution shall take effect when the writing signifying the resignation is received by the authority or person to whom it is addressed or by any person authorised by that authority or person to receive it.”

Spokesperson of the National Judicial Council and Onnoghen’s spokesman have yet to respond to enquiries on the issue.

President Muhammadu Buhari had in January suspended Onnoghen following an order received from the Code of Conduct Tribunal directing the suspension of the CJN from office pending final determination of the cases against him at the Code of Conduct Tribunal and several other fora relating to his alleged breach of the Code of Conduct for Public Officers.
